What is Labor Subleasing?

Labor leasing is a type that has been specifically regulated in the Labor Law (2019) in Article 52, accordingly: Labor leasing is when an employee signs a labor contract with an employer who is a labor leasing enterprise, then the employee is transferred to work and is under the management of another employer while still maintaining the labor relationship with the employer who signed the labor contract.

To put it simply: for example, company A is in need of 3,000 production workers in a short period of time. B is a labor leasing company that leases 3,000 production workers in that area to company A. In fact, 3,000 workers are still under contract with company B but are transferred to company A to produce to meet the needs of company A. Company B will replace A to continue to sign and manage these 3,000 workers.

Labor Subleasing Term

The maximum term for re-leasing labor is 12 months . Meanwhile, based on Clause 3, Article 23 of Decree 145 , the term of the Labor Re-leasing License is a maximum of 60 months and can be renewed multiple times , each renewal is a maximum of 60 months.
